Responsibilities of the Guam Solid Waste Management Division
United States District Court of Guam Appoints GBB
as Receiver
(Fairfax, VA – March
18, 2008) – Gershman, Brickner & Bratton,
Inc. (GBB) has been informed that on March 17, 2008, the
Honorable Frances Tydingco-Gatewood, Chief Judge of the
United States District Court of Guam, has issued a court
order appointing GBB as Receiver to achieve the Guam Government’s
compliance with the Clean Water Act as set forth in a Consent
Decree. The Decree, signed between the Government of Guam
and the United States Environmental Protection Agency (U.S.
EPA) on February 11, 2004, orders the Government of Guam
to close the Ordot Dump, cease all discharges into the
Lonfit River, open a new municipal solid waste landfill
facility, and develop and implement recycling and hazardous
waste strategies to reduce the volume of materials going
into the landfill.
Harvey Gershman, GBB President, will be the overall Officer-in-Charge
for this assignment; David L. Manning, GBB Special Principal
Associate, will serve as GBB’s Receiver representative
acting on behalf of GBB; and Chace Anderson, GBB Vice President,
will play a significant role in the assignment supported
by other GBB resources as the project dictates. "We

solely to the Court but will work closely with the elected
officials, public works, financial, and other stakeholders
of Guam to achieve full compliance with the terms of the
Consent Decree in the most cost-effective and expeditious
manner possible."
As Receiver, GBB will have full power
and authority to enforce the terms of the Consent Decree
and assume all of the responsibilities, functions, duties,
powers, and authority of the Guam Solid Waste Management
Division of the Department of Public Works, and any and
all departments or other divisions of the Department of
Public Works insofar as they affect the Government of Guam’s compliance with the Consent Decree. Working
under the guidance of the Court and in consultation with
the U.S. EPA and Guam EPA, GBB will review the work already
performed by the Government of Guam and, building upon that
work where possible, develop and execute a plan that will
provide both the financing and leadership necessary to successfully
address these vital services for the people of Guam.

About David L. Manning – GBB’s
Receiver and a GBB Special Principal Associate
David L. Manning’s career spans
more than 30 years in finance and public administration,
including executive level positions in state and local
government, with the private sector, and as an independent
consultant. He brings substantial financial management
expertise to bear in his consulting services.
Mr. Manning has served as the Chief
Financial Officer for both the Metropolitan Government
of Nashville and Davidson County and the State of Tennessee. Most recently, he
served as Director of Finance for the Metropolitan Government
of Nashville and Davidson County, appointed by Mayor Bill
Purcell. His key responsibilities included all areas of financial
management together with preparation and oversight for the
annual budget with expenditures of $1.9 billion (FY2007).
He was also the principal official responsible for planning,
development, and oversight of the Mayor’s initiative
to create a new “clean, green, and lean” solid
waste management plan for Nashville. Under the plan,
Nashville successfully implemented curbside recycling, revitalized
its district energy system, and significantly reduced the
City’s overall cost for solid waste management. Prior
to his service with Nashville, Mr. Manning served as the
Commissioner of Finance and Administration for the State
of Tennessee. Appointed by Governor Ned McWherter in
1987, he served in that capacity until the end of the Governor’s
second term in 1995. There, he oversaw the financial
and administrative management of Executive Branch agencies,
and prepared and implemented an annual budget of $12.5 billion.
In 1994, the American Society for Public Administration
awarded Mr. Manning the S. Kenneth Howard Career Achievement
Award for budget and financial management.
